Termini e condizioni d'uso

Questi termini regolano l'uso dell'app SQL Studio ("App"), fornita da IT Service ("noi"). Scaricando o usando l'App accetti questi termini e il Contratto di licenza standard di Apple per le app (EULA), che si applica a integrazione. In caso di contrasto prevalgono questi termini, nei limiti consentiti dall'EULA di Apple.

1. Licenza

Ti concediamo una licenza personale, non esclusiva e non trasferibile per usare l'App sui dispositivi Apple di tua proprietà o sotto il tuo controllo, secondo le regole di utilizzo dell'App Store. Non è consentito decompilare, modificare o redistribuire l'App, salvo nei casi consentiti dalla legge.

2. App gratuita

L'App è gratuita e non contiene acquisti in-app. Non è richiesto alcun account presso di noi. Il gateway SQL Studio (punto 3) è invece un software a pagamento, venduto separatamente alle condizioni di vendita dello store.

3. Gateway SQL Studio

Per collegarsi a SQL Server l'App richiede il gateway SQL Studio, un software che tu o la tua organizzazione installate ed eseguite sui vostri server. Non si tratta di un servizio gestito da noi: noi non ospitiamo, non gestiamo e non abbiamo accesso al tuo gateway né ai dati che tratta.

L'installazione, la configurazione e il funzionamento del gateway avvengono sotto la responsabilità di chi lo installa, in particolare per quanto riguarda: la sicurezza del server che lo ospita, il certificato TLS, gli account degli utenti e la verifica in due passaggi, l'elenco dei server consentiti, gli aggiornamenti, i backup della cartella dati e la conservazione del registro di controllo.

4. Uso responsabile

L'App permette di eseguire comandi che modificano o eliminano dati e oggetti nei tuoi database. Sei responsabile dei comandi che esegui, delle credenziali che usi e del rispetto delle autorizzazioni e delle politiche della tua organizzazione. Ti raccomandiamo di disporre di backup aggiornati e di provare le modifiche in ambienti di test prima di applicarle in produzione.

5. Esclusione di garanzie

L'App è fornita "così com'è". Nei limiti massimi consentiti dalla legge non garantiamo che l'App sia priva di errori o compatibile con ogni configurazione di SQL Server o del gateway, né che funzioni senza interruzioni.

6. Limitazione di responsabilità

Nei limiti massimi consentiti dalla legge, IT Service non risponde di danni indiretti, incidentali o consequenziali, né della perdita di dati, profitti o interruzioni di attività derivanti dall'uso o dal mancato uso dell'App o da come il gateway è installato, configurato o gestito. Restano salvi i diritti inderogabili dei consumatori e la responsabilità per dolo o colpa grave.

7. Marchi

SQL Studio è un prodotto indipendente, non affiliato né approvato da Microsoft. Microsoft, SQL Server e Azure sono marchi di Microsoft Corporation. Apple, Mac, iPhone, iPad e App Store sono marchi di Apple Inc.

8. Privacy

Il trattamento dei dati è descritto nella Privacy policy.

9. Legge applicabile

Questi termini sono regolati dalla legge italiana, fatte salve le norme inderogabili a tutela del consumatore del paese di residenza.

These terms govern the use of the SQL Studio app (the "App") provided by IT Service ("we"). By downloading or using the App you agree to these terms and to Apple's Standard Licensed Application End User License Agreement (EULA), which also applies. In case of conflict these terms prevail, to the extent permitted by Apple's EULA.

1. License

We grant you a personal, non-exclusive, non-transferable license to use the App on Apple devices that you own or control, as permitted by the App Store Usage Rules. You may not decompile, modify or redistribute the App, except where permitted by law.

2. Free app

The App is free and contains no in-app purchases. No account with us is required. The SQL Studio gateway (section 3) is paid software, sold separately under the store's terms of sale.

3. SQL Studio gateway

To connect to SQL Server, the App requires the SQL Studio gateway, software that you or your organization install and run on your own servers. It is not a service operated by us: we do not host or operate your gateway, and we have no access to it or to the data it processes.

The installation, configuration and operation of the gateway are the responsibility of whoever installs it, in particular regarding: the security of the server that hosts it, the TLS certificate, user accounts and two-step verification, the list of allowed servers, updates, backups of the data directory and retention of the audit log.

4. Responsible use

The App lets you run commands that change or delete data and objects in your databases. You are responsible for the commands you run, the credentials you use, and compliance with your organization's permissions and policies. We recommend keeping up-to-date backups and testing changes in a test environment before applying them in production.

5. Disclaimer of warranties

The App is provided "as is". To the maximum extent permitted by law, we do not warrant that the App is error-free, compatible with every SQL Server or gateway configuration, or that it will operate without interruption.

6. Limitation of liability

To the maximum extent permitted by law, IT Service is not liable for indirect, incidental or consequential damages, or for loss of data, profits or business interruption arising from the use of, or inability to use, the App, or from the way the gateway is installed, configured or operated. Mandatory consumer rights and liability for willful misconduct or gross negligence are not affected.

7. Trademarks

SQL Studio is an independent product, not affiliated with or endorsed by Microsoft. Microsoft, SQL Server and Azure are trademarks of Microsoft Corporation. Apple, Mac, iPhone, iPad and App Store are trademarks of Apple Inc.

8. Privacy

Data handling is described in the Privacy Policy.

9. Governing law

These terms are governed by Italian law, without prejudice to the mandatory consumer protection rules of your country of residence.
